Fujian: Protecting Intellectual Property Frequently Playing "Combination Boxing"
Prosecution Daily News (Reporter Zhang Renping) Two days after the industry and commerce department submitted a prosecution opinion regarding a suspected criminal case, the Chengxiang District Procuratorate in Putian City, Fujian Province, issued another notice demanding the public security agency explain why the case had not been filed. Recently, a criminal case involving the infringement of a well-known trademark with a value exceeding 1 million yuan was officially opened for investigation.
This case was discovered and corrected by the Chengxiang District Procuratorate during its supervision of the "two laws" (administrative law enforcement and criminal justice). It involved cases that were not transferred or filed properly. Since the special campaign against intellectual property infringement and the production and sale of counterfeit goods began in October 2010, prosecutors in Fujian have closely monitored administrative law enforcement agencies, addressing issues such as non-transfer of cases, unresolved matters, and lack of accountability.
By December 2010, the procuratorates had handled 4 cases where criminal investigations were substituted, supervised 14 cases involving 14 individuals, and referred one case to self-investigation departments for further review. A total of 79 people were arrested for crimes related to intellectual property infringement and the sale of fake goods, with 55 prosecuted and 88 cases under investigation. Ten individuals were pursued legally, and two major cases were directly supervised by the procuratorial organs.
During the operation, the Shishi City Procuratorate led a team to visit local administrative law enforcement units and township enterprises. They recommended that the Bureau of Industry and Commerce conduct thorough inspections of the city's clothing market. During these inspections, the industrial and commercial bureau and the public security authorities quickly raided an alleged case involving 11,430 garments infringing on a well-known trademark, with a total value exceeding 2 million yuan.
The Shishi City Procuratorate received the notification immediately and worked closely with the industry and commerce and public security departments. Prosecutors intervened early to understand the case and provided specific guidance on collecting and securing evidence. The case was officially filed just seven days after it was transferred to the public security agency, and the investigation concluded within 17 days. On January 24, 2011, the Shishi City Procuratorate approved the arrest of suspect Su on the same day the case was filed.
This case highlights the growing collaboration between procuratorial and law enforcement agencies in tackling intellectual property crimes, ensuring that even complex and high-value cases are swiftly addressed and properly investigated.
