Fujian: Protecting Intellectual Property Frequently Playing "Combination Boxing"
Prosecution Daily News (Reporter Zhang Renping) Two days after the industry and commerce department submitted a prosecutorial opinion regarding a suspected criminal case, the Chengxiang District Procuratorate in Putian City, Fujian Province, issued another notice demanding the public security agency explain why the case had not been filed. This came after an infringement case involving a well-known trademark with a value exceeding 1 million yuan was finally opened for investigation.
This case was discovered and rectified by the Chengxiang District Procuratorate as part of its supervision under the "two laws" system, where cases were not transferred or filed properly. Since the special campaign to crack down on intellectual property infringement and the production and sale of counterfeit goods began in October 2010, the procuratorial organs in Fujian have closely monitored administrative law enforcement agencies. They identified and addressed instances of untransferred cases, unresolved matters, and impunity.
By December 2010, they had supervised the transfer of four criminal cases, directed the public security authorities to investigate 14 cases involving 14 individuals, referred one case for self-investigation, and prosecuted 79 people for intellectual property crimes, with 55 more being investigated and 10 pursued for prosecution. Two major cases were also under close supervision.
During this period, the Shishi City Procuratorate led a team to visit local administrative law enforcement units and township enterprises, urging the Bureau of Industry and Commerce and other departments to conduct comprehensive inspections of the city’s clothing market. During these inspections, the industrial and commercial bureaus and public security agencies launched a joint operation, seizing over 11,430 garments suspected of infringing a well-known trademark, with a total value exceeding 2 million yuan.
The Shishi City Procuratorate received the notification immediately and worked closely with the relevant departments. Prosecutors intervened early, providing detailed guidance on evidence collection and preservation. The case was officially filed just seven days after it was handed over to the public security agency, and the investigation concluded within 17 days. On January 24, 2011, the procuratorate approved the arrest of suspect Su on the same day the case was filed.
This proactive approach highlights the growing collaboration between prosecutors, law enforcement, and administrative bodies in addressing intellectual property violations and ensuring that justice is served efficiently and effectively.
